We will respond to verified requests within 45 days. In some cases, we may need to verify your identity before processing your request.

YOUR RIGHTS BY STATE

California Residents — California Consumer Privacy Act (CCPA/CPRA)

If you are a California resident, you have the following rights with respect to your personal information:

Right to know — request disclosure of the categories and specific pieces of personal information we have collected about you, the sources from which we collected it, the purposes for which we use it, and the third parties with whom we share it.
Right to access and portability — obtain a copy of the personal information we hold about you in a portable format.
Right to correct — request correction of inaccurate personal information we maintain about you.
Right to delete — request that we delete personal information we have collected from you, subject to certain exceptions.
Right to opt out of sale or sharing — direct us not to sell or share your personal information with third parties for targeted advertising purposes.
Right to limit use of sensitive personal information — restrict how we use sensitive personal information beyond what is necessary to provide our services.
Right to non-discrimination — we will not discriminate against you for exercising any of these rights.
Right to appeal — if we deny your request, you have the right to appeal our decision.

We do not sell your personal information as that term is defined under the CCPA/CPRA. We will process verified requests within 45 days, with a possible 45-day extension where reasonably necessary.

Texas Residents — Texas Data Privacy and Security Act (TDPSA)

If you are a Texas resident, you have the following rights with respect to your personal data:

Right to access — confirm whether we are processing your personal data and access that data.
Right to correct — request correction of inaccurate personal data we hold about you.
Right to delete — request deletion of personal data you have provided to us or that we have collected about you.
Right to data portability — obtain a copy of your personal data in a portable and readily usable format.
Right to opt out — opt out of the processing of your personal data for purposes of targeted advertising, sale, or profiling in furtherance of decisions that produce legal or similarly significant effects.
Right to appeal — if we deny your request, you may appeal our decision within a reasonable time after receiving our response.

Global Privacy Control (GPC): We recognize and honor browser-based Global Privacy Control signals as a valid opt-out of the sale and targeted advertising of personal data, as required by the TDPSA effective January 1, 2025.

We will respond to authenticated requests within 45 days, with a possible 45-day extension where reasonably necessary.

All Customers — Gramm-Leach-Bliley Act (GLBA) Financial Privacy

As an insurance Managing General Agent (MGA), Monarch Sky MGA, Inc. is subject to the Gramm-Leach-Bliley Act (GLBA). The GLBA governs how financial companies like us collect, use, and share nonpublic personal financial information (NPI) about our customers.

What we collect
We may collect NPI you provide on applications and forms; information about your transactions with us and our affiliates; and information from consumer reporting agencies or insurance databases.

What we share and why
We share NPI with affiliated companies and select non-affiliated third parties as permitted by law, including:

Insurance carriers and reinsurers to place or service your coverage
Service providers that perform functions on our behalf (such as technology vendors and claims administrators)
Regulatory authorities, as required by law

Your right to opt out

How we protect your information
We maintain physical, electronic, and procedural safeguards designed to comply with federal and state standards to protect your NPI from unauthorized access and use.

Other State Residents

Residents of Colorado, Connecticut, Virginia, New Jersey, Oregon, Minnesota, Delaware, Iowa, Nebraska, Tennessee, Montana, and other states with comprehensive consumer privacy laws may also have rights to access, correct, delete, and opt out of the sale or sharing of their personal data. Submit a request using the form above and indicate your state of residence — we will respond in accordance with the applicable law for your state.

Authorized Agents

You may designate an authorized agent to submit a privacy request on your behalf. To verify the agent’s authority, we may require a signed letter of authorization or valid power of attorney. We may still need to verify your identity directly in connection with the request.

Non-Discrimination

We will not discriminate against you for exercising any of your privacy rights. You will not receive a different level of service or be denied coverage based solely on submitting a privacy request.
